These Terms of Use (hereinafter "Terms") govern the use of the **Brainsto.re** web application accessible at brainsto.re.

**By using Brainsto.re, you unconditionally accept these Terms.**

## 1. Purpose

**Brainsto.re** is a free web application allowing the use of generative artificial intelligence (AI) models directly in your browser for:

- Text generation (conversations, writing, code, etc.)
- Web search and information retrieval tools
- Text-to-Speech synthesis
- Speech-to-Text recognition
- **Document reading and analysis** (PDF, DOCX, TXT, code files up to 10MB)
- **Intelligent tools** accessible to the AI:
  - Wikipedia search
  - Real-time weather information
  - Latest news retrieval
  - DuckDuckGo instant answers
  - Geolocation services
  - Date/time/timezone information
  - Web content fetching
  - Attached file reading

The application runs entirely locally in your browser without requiring a user account.

## 2. Service Access

### 2.1 Access Conditions

Using Brainsto.re requires:

- A modern compatible web browser (Chrome, Edge, Firefox recommended)
- An HTTPS connection (required for WebAssembly)
- Sufficient hardware resources:
  - Minimum 4 GB of available RAM
  - Recent processor with WebAssembly support
  - Internet connection for initial model download

**Note**: Safari may have compatibility limitations.

### 2.2 Availability

The publisher strives to keep the application accessible 24/7, but cannot guarantee:

- Continuous service availability
- Absence of technical errors
- Compatibility with all browsers and devices
- Performance on resource-limited devices

Service access may be temporarily suspended for maintenance, updates, or any technical reason, without prior notice.

### 2.3 Free Service

The use of Brainsto.re is **completely free**. No fees will be charged to users.

The publisher reserves the right to modify this pricing policy in the future, with prior notification to users.

## 3. Use of the Application

### 3.1 Permitted Use

You are authorized to use Brainsto.re for:

- Personal, educational, or professional use
- Generating textual or visual content
- Testing and discovering AI model capabilities
- Developing open-source projects based on Brainsto.re (according to code license)

### 3.2 Prohibited Uses

It is strictly prohibited to use Brainsto.re for:

- Generating illegal, defamatory, hateful, violent, or pornographic content
- Harassing, threatening, or harming third parties
- Impersonating a person or entity
- Violating third-party intellectual property rights
- Attempting to bypass application security measures
- Using the application for fraudulent or malicious purposes
- Automating intensive use (scraping, abusive bots)
- Disseminating medical, legal, or financial information as professional advice
- **Uploading malicious files** (malware, viruses, exploits)
- **Uploading copyrighted documents** without proper authorization
- **Excessive use of external APIs** via AI tools (weather, news, etc.)

**In case of violation, the publisher reserves the right to block access to the application.**

### 3.3 User Responsibility

**You are solely responsible for**:

- The content you generate with Brainsto.re
- The use you make of generated results
- Verifying the accuracy of information provided by the AI
- Compliance with applicable laws and regulations
- **Documents you upload** - Ensure you have the right to upload and process them
- **Third-party API usage** - External services (Wikipedia, weather, news, etc.) are called when AI uses tools
- **Respecting file size limits** (10MB maximum per file)

## 4. Specific Warnings for Generative AI

### 4.1 Reliability of Generated Content

- **Generate inaccurate information** ("hallucinations")
- **Produce biased content** (reflections of training data)
- **Make errors in logic, calculation, or reasoning**
- **Invent sources, references, or citations**
- **Generate offensive or inappropriate content**

**It is your responsibility to verify all critical information from reliable sources.**

### 4.2 Temporal Limitations

AI models were trained on data prior to **early 2025**. They may have **limited or no knowledge of recent events**.

### 4.3 Not Professional Advice

**Brainsto.re should NOT be used as a substitute for professional advice** in the following areas:

- Medical (diagnosis, treatment, prescription)
- Legal (legal advice, law interpretation)
- Financial (investment, taxation, accounting)
- Psychological (therapy, mental diagnosis)

**When needed, always consult a qualified professional.**

### 4.4 AI Content Detection

Content generated by Brainsto.re may be detectable by AI detection tools. If you use this content in an academic or professional setting:

- Respect your institution/employer rules
- Cite AI use if required
- Do not present generated content as entirely original

## 5. Intellectual Property

### 5.1 Source Code Ownership

Brainsto.re source code is **proprietary** and subject to copyright protection.

The source code is not publicly available and all rights are reserved by the copyright holder.

### 5.2 Generated Content Ownership

**Content you generate with Brainsto.re belongs to you**, subject to:

- Respect for third-party rights
- Limitations imposed by AI model licenses (see 5.3)
- Applicable intellectual property law

**The Brainsto.re publisher claims no rights to your creations.**

### 5.3 AI Model Licenses

AI models used are subject to their own licenses:

### 5.4 Trademarks and Logos

AI model names and logos (Llama, Qwen, Phi, Mistral, etc.) are registered trademarks of their respective owners. Brainsto.re uses them only for identification purposes.

## 6. Personal Data

Processing of your personal data is detailed in our [Privacy Policy](PRIVACY_POLICY.md).

**Key points**:

- Your conversations and uploaded documents remain on your device (no server)
- External APIs are called only when AI uses specific tools:
  - Wikipedia (search queries)
  - Open-Meteo (weather requests)
  - ipapi.co (geolocation)
  - DuckDuckGo (search queries)
  - RSS feeds (news retrieval)
  - CORS proxy (web content fetching)
- Document processing (PDF, DOCX) is performed entirely locally in your browser
- You can delete your data at any time (conversations + attached files)

## 7. Limitation of Liability

### 7.1 Publisher Liability

**The Brainsto.re publisher cannot be held responsible for**:

- **Errors, inaccuracies, or hallucinations** generated by AI models
- **Consequences of using generated content** (decisions, actions, publications)
- **Losses or damages** resulting from use or inability to use the application
- **Bugs, interruptions, or malfunctions** technical issues
- **Incompatibility** with certain browsers or devices
- **Offensive or inappropriate content** generated by AI
- **Third-party rights violations** arising from generated content
- **Errors in document processing** (PDF/DOCX extraction issues)
- **Data loss** from uploaded documents
- **Failures or unavailability** of third-party APIs (Wikipedia, weather, news, etc.)
- **Accuracy of information** retrieved from external sources (weather, news, Wikipedia)
- **Privacy practices** of third-party services (see Privacy Policy)

### 7.2 "As Is" Provision

Brainsto.re is provided **"as is"** and **"as available"**, without warranty of any kind, express or implied, including:

- Merchantability warranty
- Fitness for a particular purpose warranty
- Accuracy or reliability warranty
- Absolute security warranty

### 7.3 Financial Limitation

In any event, the publisher's liability is limited to direct and foreseeable damages. **No compensation for indirect damages** (data loss, lost profits, business harm, etc.).

## 8. Force Majeure

The publisher cannot be held responsible for non-performance of obligations in case of force majeure, including:

- Natural disasters
- Widespread power outages
- Cyber attacks (DDoS, hacking)
- Government or regulatory decisions
- Third-party provider failures (HuggingFace, Wikipedia, Open-Meteo, ipapi.co, DuckDuckGo, RSS feed providers, CORS proxy)

## 9. External Links

The application may contain links to external sites (notably Wikipedia). The publisher has no control over these sites and disclaims all responsibility for their content.

## 10. Terms Modifications

The publisher reserves the right to modify these Terms at any time. Modifications will take effect upon publication.

In case of substantial modification, a notification will be displayed in the application.

**It is your responsibility to regularly consult the Terms.**

Continued use after modification constitutes acceptance of the new Terms.

## 11. Applicable Law and Jurisdiction

These Terms are governed by **French law**.

In case of dispute, and failing amicable resolution, exclusive jurisdiction is granted to **French courts**.
